OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1. Sponsor: Kia Motors America, Inc., 111 Peters Canyon Road, Irvine, California 92606 (“Sponsor”)
2. Sweepstakes Entry Period: The #LPGAKiaAwards Fan Vote & Sweepstakes (“Sweepstakes”) begins at 12:00 PM Eastern Time (“ET”) on October 1, 2015, and ends at 11:59 PM ET on October 19, 2015 (“Sweepstakes Entry Period”).
3. Eligibility: The Sweepstakes is open only to legal residents of, and physically residing within, the United States including the District of Columbia, eighteen (18) years of age or older as of the entry date. Employees, officers, directors, agents and representatives of Sponsor, Ladies Professional Golf Association, Inc. (hereafter, “LPGA” or “Administrator”), LPGA Tournament Properties One, LLC, CME Group Inc., IMG, IMG Live and each of their respective parents, affiliates, subsidiaries, agents, sponsors, wholesalers, retailers, distributors, suppliers, advertising and promotion agencies (collectively, “Released Parties”), members of their immediate family (spouse, parent, legal guardian, child, sibling and their child, grandparent, grandchild and/or in-law) regardless of where they reside and/or individuals living in their same household, whether or not related, are not eligible to enter or win. Void where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws and regulations.
4. How to Enter: During the Sweepstakes Entry Period, eligible individuals may enter the Sweepstakes and receive a chance to win the grand prize by voting for one (1) of the Kia most compelling performances by visiting http://www.lpga.com/LPGAKiaAwards and following the instructions to vote and to complete and submit the registration form (“Entry”).
All eligible Entries must be received by 11:59 PM ET on October 19, 2015, to be eligible for the grand prize drawing. The Administrator’s computer shall be the official clock for purposes of this Sweepstakes. Limit one (1) Entry per person, per day for the duration of the Sweepstakes Entry Period. More than the specified number of Entries from any person or e-mail address will void all Entries for that person. For the purpose of this Sweepstakes, a day is a 24-hour period that starts at 12:00 AM ET and ends at 11:59 PM ET that same day, except for the first day of the Sweepstakes which begins at 12:00 PM ET. All Entries become the exclusive property of the Administrator and will not be acknowledged or returned. The use of any script, macro, automated, robotic, repetitive or programmed devices (or any other devices intended to automate or subvert any aspect of Entry) to enter the Sweepstakes is prohibited and will result in disqualification at Administrator’s sole discretion. In the event of a dispute as to the identity of an entrant based on the e-mail address submitted, entrant will be deemed to be the authorized account holder of the email address used to enter the Sweepstakes. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder, as determined exclusively by the Administrator in its sole discretion. Sponsor and/or Administrator are not responsible for lost, late, garbled, illegible, incomplete, inaccurate or misdirected Entries.
5. Winner Selection: One (1) potential grand prize winner will be selected in a random drawing conducted on or about October 20, 2015, from among all eligible Entries received during the Sweepstakes Period (“Winner”). The drawing will be conducted by Administrator, whose decisions are final on all matters relating to the drawing. Odds of winning the grand prize is dependent upon the number of eligible Entries received during the Sweepstakes Entry Period. By entering, entrants agree to be bound by these Official Rules and to the decisions of the Administrator and/or Sponsor, which will be final and binding in all respects. If you disagree with the terms of the Official Rules, do not submit a registration form and/or do not participate in the Sweepstakes. Receipt of an Entry shall be evidence of each entrant’s acceptance of all terms contained in these Official Rules.
6. Winner Notification: The potential winner will be notified by telephone, email or direct message, and will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within five (5) days of date of notification. Administrator shall attempt to contact the potential winner two (2) times over a period of two (2) days, via telephone and/or email, using the contact information provided by the entrant. Non-compliance with the foregoing or with these Official Rules in any way, the inability to contact the potential winner (as specified above), or return of prize notification as non-deliverable may result in disqualification and, at Sponsor’s and/or Administrator’s discretion and time permitting, the awarding of the prize to an alternate potential winner in a random drawing from among all remaining Entries. Entrants agree, by entering, that Administrator reserves the right to conduct a background check and Entry in the Sweepstakes constitutes entrant’s permission for the Administrator to conduct such background check, provided that, to the extent additional authorization is necessary under law, entrants shall authorize such check. Administrator reserves the right (at its sole discretion) to disqualify any entrant based on the results of the background check or failure of the entrant to properly authorize such check. The Winner’s guest will be required to execute a Liability and (where legal) Publicity Release prior to the issuance of travel documents. Guest must be of legal age of majority in his/her state of residence (and at least eighteen (18)) unless he/she is the child or legal ward of the Winner. If the guest is a minor, the Winner must sign and return a Liability and (where legal) Publicity Release on behalf of such child or legal ward.
7. Grand Prize: One (1) Winner will receive a Grand Prize package consisting of a trip for two (2) to the 2015 CME Group Tour Championship, scheduled to be held Tuesday through Sunday, November 19 – 22, 2015, in Naples, Florida (“Tournament”). The Grand Prize package includes:
Round-trip, coach, airfare for two (2) guests from a major commercial airport located in the U.S. nearest the Winner’s residence to Fort Myers, Florida;
Standard hotel accommodations (one (1) room, double occupancy) for five (5) nights, November 17 – 22, 2015, in or around the greater Naples, Florida area (standard fees and taxes included, but excludes all additional fees and taxes, including, without limitation, food and beverages (except as specified below), room service, movies, telephone, hotel upgrades, personal incidentals, and other guest and amenity services);
Hotel credit voucher valued at Five Hundred Dollars ($500.00) to be used toward hotel food and beverage consumption, valid November 17 – 22, 2015;
Complimentary local use of a Kia automobile (model/year determined by Sponsor and/or Administrator) November 17 – 22, 2015 (subject to additional vehicle terms and conditions);
Two (2) passes for admission to the 2015 CME Group Tour Championship Tournament grounds, valid November 19 – 22, 2015;
Two (2) weekly passes for admission to the Globe Lounge hospitality suite (valid all week, November 19 – 22, 2015);
Two (2) passes for one (1) day admission, as determined by Administrator in its sole discretion, to the “Inside the Ropes” experience at the Tournament; and
Invitation for two (2) to attend the Kia Performance Awards presentation ceremony, scheduled to be held on Wednesday, November 18, 2015, from 4:00 PM – 6:00 PM at the Ritz Carlton Golf Resort in Naples, FL.
Approximate Retail Value of the Grand Prize Package is Four Thousand Nine Hundred Dollars ($4,900.00). Actual value may vary based upon location of Winner’s residence, hotel fluctuations, and other external factors.
All prize details, including but not limited to, exact passes and Tournament access given thereto, are at Administrator’s sole discretion and Administrator reserves the right to substitute any prize with one of comparable or greater value. In the event Tournament is postponed and rescheduled, trip will be rescheduled around the dates of the rescheduled Tournament. In the event Tournament is postponed and not rescheduled or otherwise cancelled, no compensation or substitution for such portion of the prize will be provided. If Winner resides within a 150-mile radius of Naples, FL, ground transportation (or other form of transportation) and/or use of a rental car (model/year determined by Administrator; subject to additional vehicle terms and conditions) may be provided in lieu of air transportation, at Administrator’s sole discretion, and no compensation or substitution will be provided for difference in prize value. Car rental portion of the Grand Prize may be subject to additional restrictions and requirements imposed by car rental company, including but not limited to, possession of a valid major credit card, U.S. driver’s license, insurance and minimum age requirement. The Grand Prize is non-transferable. No prize substitution or cash redemption allowed, except as provided herein. No compensation or substitution will be provided for difference in prize value if Winner is not eligible and/or does not meet the age or other requirements designated by car rental company. Trip must be taken on dates designated by Administrator or prize will be forfeited in its entirety and, at Administrator’s discretion and time permitting, awarded to an alternate winner. Travel dates subject to change. Travel and accommodation restrictions and other restrictions may apply. Winner and guest must travel together on same itinerary and are responsible for obtaining all required travel documents. All travel arrangements must be made through travel agent of Administrator’s selection on a carrier of Administrator’s choice. Released Parties are not responsible for delays, cancellations, diversions or substitution or any act or omissions whatsoever by air carriers, hotels, or other transportation companies or any other persons providing any of these services/accommodations, or for the cancellation of any or all days of the Tournament. Any costs incurred due to changes to the original itinerary are solely the Winner’s responsibility. All costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes, any ground transportation, food, beverages, souvenirs, gratuities, airline luggage charges, and other miscellaneous travel expenses are Winner’s sole responsibility. The Winner may be required to provide a valid major credit card upon hotel, rental car, and other check-ins, which will cover all expenses, fees, and other charges not provided for herein. The Winner is responsible for the reporting and payment of any and all taxes or fees (including, but not limited to, federal, state and local taxes) associated with a prize and for any and all other costs and expenses not specifically described herein, including, without limitation, meals, beverages, gratuities, travel upgrades, baggage fees, and personal incidentals. The Winner is responsible for obtaining travel insurance (and all other forms of insurance) that they may wish to obtain (at their own expense) and hereby acknowledge that neither the Sponsor nor the Administrator will obtain or provide travel insurance or any other form of insurance. An IRS Form 1099 will be issued in the name of Winner for the actual value of the prize received. Tournament passes are subject to terms and conditions specified thereon. Winner and guest must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the prize and removal from Tournament. The Released Parties reserve the right to remove or to deny attendance to Winner and/or guest who engages in a non-sportsmanlike, disruptive or inappropriate manner, or with intent to annoy, abuse, threaten or harass any other person at any event, or otherwise violate the terms set forth on the back of the Tournament pass. Unused passes cannot be refunded, exchanged for cash value, substituted or applied towards passes for any subsequent event.
8. Limitation of Liability: Released Parties and/or Lodestone Social Media are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, inaccurate, or undelivered Entries, or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of Entries or the announcement of the prize; or for any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes, or for printing, typographical, human or other errors appearing in these Official Rules or other Sweepstakes-related materials. Administrator reserves the right, in its sole discretion, to void any Entries of entrants whom Administrator believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes or is in violation of these Official Rules. Those entrants participating in the Sweepstakes do so at their own risk. The Released Parties and/or Lodestone Social Media shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use, nonuse or misuse of the prize and any travel or travel-related activity thereto (including, but not limited to, attendance at the Tournament) or participation in this Sweepstakes. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Entrants agree that this Sweepstakes is not sponsored, endorsed or administered by or associated with Facebook and/or Twitter.
9. Publicity: Entrants agree, by entering, that Sponsor, Administrator and their designees may use entrant’s name, city and state of residence, photograph, any recording (voice, film or video), and/or likeness for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, except where prohibited by law. By entering the Sweepstakes and not withstanding anything to the contrary, entrant agrees that Sponsor and/or Administrator may use entrant’s personal identifiable information for marketing purposes.
10. Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) is permitted except by Administrator who reserves the right to substitute the prize (or applicable portion thereof) with one of comparable or greater value, at its sole discretion.
Entrants agree, by entering, that Administrator reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Sweepstakes (or portion thereof) for any reason, including should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, in the case of termination, at its discretion, select the Winner from eligible non-suspect Entries received prior to the event that required such termination. Any attempt to deliberately damage the website or undermine the legitimate operation of this Sweepstakes or the official rules is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
11. Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) and held at the AAA regional office in Florida; (2) the commercial rules of the AAA, then in force, shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased. Entrant further agrees that Administrator has neither made nor is responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose.
12. Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Florida.
