NO REFUNDS OR EXCHANGES | EVENT DATES & TIMES SUBJECT TO CHANGE
This ticket is a revocable license allowing access to the golf tournament ("Event") identified on the ticket. The person seeking entry pursuant to this license, and any accompanying minors (collectively “Holder”), agrees that this ticket license is subject to the abbreviated terms on the back of the ticket and the full terms and conditions at https://www.lpga.com/ticket-terms-and-conditions (collectively “Terms”). By acceptance and/or use of the ticket for the Event, Holder is deemed to have read the Terms and agreed to be bound by them. Failure to comply with any of these Terms shall result in forfeiture of the license and all rights arising hereunder, without refund, and shall entitle the TOUR, tournament owner/operator(s) and host golf course (individually and collectively, “Management”) to pursue all legal remedies available. Admission may be refused or revoked, and Holder may be ejected in the sole discretion of Management. Management’s liability for any breach of any term of the ticket shall not exceed face value of the ticket set by Management (the “Face Value”).
IN NO EVENT SHALL MANAGEMENT BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF THE FACE VALUE FOR THIS TICKET.
HOLDER VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS incident to the Event and related events, including the risk of personal injury (including death), the risk of exposure to communicable diseases, viruses, bacteria or illnesses or the causes thereof, sickness, or lost, stolen or damaged property, whether occurring before, during, or after the Event, however caused, and hereby waives all claims and potential claims against the Released Parties relating to such risks, hazards and dangers.
RELEASE & INDEMNITY AGREEMENT
HOLDER AGREES TO INDEMNIFY, HOLD HARMLESS AND COVENANT NOT TO SUE THE RELEASED PARTIES FROM AND AGAINST ANY LOSSES OR LIABILITY RELATED TO HOLDER’S USE OF THE TICKET. Released Parties are listed on the back of the ticket.
Holder hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE THE RELEASED PARTIES, from all liability to Holder, his/her personal representatives, assigns, heirs, and next of kin for any and all loss or damage, and any claim or demands therefore on account of personal injury, death, or loss or damage to personal, private, or other property and equipment, whether caused by the negligent acts or omissions of the Released Parties or otherwise, resulting from or arising out of Holder’s attendance at the Event.
HOLDER AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASED PARTIES from and against any losses or liabilities they may incur due to Holder’s use of the ticket, including, without limitation, acts or omissions or allegations thereof while present at or around the Event.
Holder agrees that the foregoing release & indemnity agreement is intended to be as broad and inclusive as is permitted in the state in which the Event takes place, and if any portion thereof is held invalid for any reason, it is agreed that the balance shall continue in full legal force and effect.
Any disputes involving the Released Parties shall be resolved by arbitration in the State of Florida pursuant to the Commercial Rules of the American Arbitration Association then in force. A judgment upon the award rendered by the arbitrator(s) shall be final and non-appealable and may be entered in any court having jurisdiction thereof.
MEDIA RIGHTS
The TOUR owns the rights to all images, sounds and data from this Event. For more information, contact TOUR Media at 100 International Drive, Daytona Beach, Florida, 32124.
Limited Media License. TOUR grants Holder a limited license to use any photographs, images, videos, audio or other form of display or public performance or reproduction of any portion of the Event or related events (the “Works”) for Holder’s personal, non-commercial use only (e.g., for Holder’s personal social media accounts) (“Licensed Content”). Works does not include, and this license does NOT include scoring-related data or statistics. Licensed Content may NOT be distributed on a real time bases (no live streaming or stroke by stroke account). Holder hereby assigns TOUR, as sole owner, all right, title and interest in and to all Licensed Content, including all copyrights and rights to use all Licensed Content in any way.
Holder agrees NOT to create, transmit, display, distribute, exploit, misappropriate or sell (or aid in such activity) (1) in any form, any description or account (whether text, data or visual, and including, without limitation, play-by-play data) of the Event or related events (collectively, the “Descriptive Data”) for any commercial or non-personal, purpose; (2) the Works for any commercial or non-personal purpose; or (3) livestreams of any portion of the Event or related events (the “Livestreams”). Notwithstanding the foregoing, Holder agrees that by causing the ticket to be scanned upon entry to the Event, Holder shall be deemed to have signed the ticket and granted TOUR an exclusive worldwide, irrevocable, perpetual, sub-licensable, royalty-free license to all rights associated with the Works, the Livestreams, and, to the extent permitted by law, the Descriptive Data (including without limitation rights to use Holder’s social media posts from or about the Event).
Holder also grants irrevocable permission to Management and their respective affiliates & licensees to use Holder’s image, likeness, voice, actions and statements captured at the Event in any medium, including without limitation, live telecast, social media, video recording or photograph in any and all media now known or hereafter developed (in whole or in part) for any purpose without further authorization or compensation, and waives all claims and potential claims relating to such use unless prohibited by law.
POLICIES
Holder must comply with all TOUR and Event policies, including without limitation any security and fan conduct policies, health and safety policies and assessments, and any applicable bag policies. Holder and Holder’s belongings may be searched or assessed prior to or upon entry into the Event. Prohibited items may be confiscated and/or Holder may be denied admission or have his or her admission revoked at any time at the sole discretion of Management. Holder consents to such searches and assessments and waives all claims relating to them. If Holder does not consent to such searches and assessments, Holder acknowledges that Management has the right to deny admission or to eject Holder from the Event without refund. Management reserves the right to deny admission to or eject any person who Management, in its sole discretion, determines poses a risk to the health and safety of other attendees and/or whose conduct violates these Terms, any applicable code of conduct, or is otherwise disorderly (or complicit in such conduct) without refund.
Holder agrees that this ticket may not be resold or offered for resale on any platform other than a platform expressly authorized by Management, subject to applicable law. Management is not responsible for lost, stolen, destroyed, duplicated or counterfeit tickets and may refuse to honor such tickets. Further, the ticket may not be used for, or in connection with, any form of commercial or trade purposes including, but not limited to, any advertising, promotions, contests, sweepstakes, giveaways, gambling or gaming activities, without the express written consent of Management. Use of the ticket in violation of any law is strictly prohibited and will result in seizure, revocation and/or forfeiture of the ticket/license without refund.
The date and time of the Event (and the opening of the gates) are subject to change by Management in its sole discretion, and no such change shall entitle Holder to a refund or any other remedy if Holder cannot attend or for any other reason.
Use of any parking site provided for attendees is entirely at the risk of the vehicle driver and/or owner. Please take appropriate security precautions and lock your vehicle.
Holder is deemed to have given all of the foregoing grants of rights, releases and waivers on behalf of any minors accompanied by Holder.
